What are the requirements to apply for a spouse visa?

You may be able to apply for a UK spouse visa if you are married to, in a civil partnership with, or living in the UK with a British citizen or someone with established residency. Applicants for a Spouse Visa must:

⦁ Be over the age of 18.

⦁ Under UK law, the marriage or civil partnership must be recognised.

⦁ Demonstrate they won't be a financial burden on the state and must meet the financial criterion. You can prove this in several ways, such as with salary of more than £18,600, savings of more than £62,500, a pension, and/or a property portfolio.

⦁ Pay for the Immigration surcharge.

⦁ Provide an A2 certification for the English Language requirements (maybe exempt if you are from an English-speaking country)

⦁ Provide a Tuberculosis test (maybe exempt depending on the country)

Can I apply for EEA permanent residency?

Once you have lived continuously in the UK for five years, you may apply for EEA Permanent Residence status. Additionally, you will need to provide evidence that you have been using your treaty rights during those five years. If you have been working or studying while you have been here, you have been exercising your rights.

What is the minimum income I need to sponsor my spouse/partner to join me in the UK?

The UK home office had set the minimum income required to sponsor your spouse or partner to come to the UK as £18,600.This income requirement increases to £22,400 for one dependant child and £2400 for every further child.In July 2013, all decisions in relation to sponsors that do not meet the criteria have been placed on hold as a judgement had been made stating the minimum income required was 'unjustified and disproportionate'.
